Terms and conditions of purchase and delivery

I. SCOPE AND DEFINITIONS

1. The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
2. A “consumer” within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that cannot predominantly be attributed to their commercial or self-employed professional activity.

II. CONCLUSION OF CONTRACT AND STORAGE OF CONTRACT TEXT

1. The presentation of vouchers in our online shop does not constitute a legally binding offer on our part but merely a non-binding invitation to consumers to place an order. By ordering the desired voucher, the consumer submits a binding offer to conclude a purchase agreement.
2. Upon receipt of an order in our voucher shop, the following provisions apply: The consumer submits a binding contractual offer by successfully completing the ordering process provided in our voucher shop.

The ordering process consists of the following steps:

1. Select the desired voucher
2. Enter the voucher amount
3. Personalize the voucher
4. Select the delivery method
5. Choose the quantity and add the voucher to the shopping cart
6. For additional vouchers: repeat steps 1–5
7. Review the shopping cart
8. Proceed by clicking “Order”
9. Enter billing/delivery address and contact details
10. Select the payment method; if paying by credit card, enter card details
11. Review and, if necessary, correct the entered information
12. Read and accept the Terms and Conditions by checking the box
13. Read and accept the cancellation policy by checking the box
14. Submit the order in a binding and chargeable manner

Before submitting the binding order, the consumer may return to the previous page using the browser’s “Back” button, correct any input errors, or cancel the ordering process by closing the browser. We confirm receipt of the order immediately by means of an automatically generated email (“Order Confirmation”). By doing so, we accept your offer.

For security reasons, your order data is no longer accessible via the Internet.

III. PRICES, SHIPPING COSTS, PAYMENT, AND DUE DATE

1. Vouchers may be paid for using all available payment methods and can be delivered free of charge by email. Delivery by postal mail is also available and is subject to postage charges.
2. The stated prices include the applicable statutory VAT. The voucher value is redeemed upon use of the corresponding service. Additional shipping costs apply if the delivery method “Send by Post” is selected.
3. Vouchers cannot be redeemed for cash. If the value of services consumed is less than the voucher value, a corresponding credit balance will be issued.
4. No liability is assumed for delays in postal delivery.
5. A voucher becomes valid only after the full amount due has been paid.

IV. DELIVERY

Vouchers can be printed immediately by the consumer or saved as a PDF file. If the delivery method “Send by Post” is selected, a printed voucher will be sent by mail. Postage charges apply.

V. RETENTION OF TITLE

We reserve the right to refuse redemption of the voucher until the purchase price has been paid in full.

VI. VALIDITY

Vouchers are valid for three (3) years from the date of purchase and are assigned a unique serial number required for redemption. Each voucher may only be redeemed once.

VII. REDEMPTION

The voucher holder may redeem the voucher for any hotel services offered. Redemption is carried out on a currency exchange basis:

1 voucher euro = 1 hotel euro

VIII. LOSS

In the event of loss, theft, or misappropriation of vouchers, THOMA HOTELS & WELLNESS GMBH cannot provide a replacement.

IX. DEVIATIONS AND ERRORS

The appearance of vouchers offered for sale may differ from the illustrations shown. Errors and changes are reserved.

X. SECURITY GUARANTEE & DATA PROTECTION

1. The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with applicable data protection laws. Such data will not be disclosed to third parties. Please note that data transmission over the Internet may have security vulnerabilities. Complete protection of data against access by third parties is not possible.
2. This website uses SSL/TLS encryption for security reasons. An encrypted connection can be recognized when the browser address changes from “http://” to “https://” and a padlock symbol appears. When encryption is activated, transmitted data cannot be read by third parties.

XII. CONTRACT LANGUAGE

The contract language is exclusively German.

XIII. PLACE OF PERFORMANCE, JURISDICTION, AND APPLICABLE LAW

For contracts with merchants, legal entities under public law, and special funds under public law, Freiburg shall be the place of performance for delivery and payment and the place of jurisdiction. However, the provider is also entitled to bring legal action at the consumer’s place of residence or business establishment.

If the consumer has no general place of jurisdiction in Germany or relocates their residence or habitual place of abode outside the Federal Republic of Germany after conclusion of the contract, the provider’s registered office shall be the place of jurisdiction. The same applies if the consumer’s residence or habitual place of abode is unknown at the time legal proceedings are initiated.

The law of the Federal Republic of Germany shall apply, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

CANCELLATION POLICY

Right of Withdrawal

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The withdrawal period is fourteen days from the date the contract is concluded.

by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this reimbursement.

If you selected the delivery method “Send by Post” and the voucher has already been dispatched, you will bear the direct costs of returning the voucher.
